When pitched to voters, Marsy's Law - Proposition 9 - promised victims and their families the right to reasonable notice upon request of all public proceedings, with few exceptions.  Its passage significantly expanded victims' rights and included them in the state Constitution. But making it work has been tricky, said Deputy District Attorney Steve Ipsen, who co-authored the law and is running for Los Angeles County District Attorney in 2012.

We know that Deputy District Attorney Alan Jackson is running for the post of district attorney, but Friday he just seemed to be running from our phone calls.  We wanted to know why a Palmdale woman was literally crying to us about the plea-bargain deal her brother’s killer received.  Deputy DA Jackson did not return our calls.

WASHINGTON —The Supreme Court by a 5-4 vote Monday ruled California prison overcrowding unconstitutional and upheld an order that could force the release of about 40,000 inmates to solve longstanding problems with inmate medical care and mental disorders.

Prosecutor Ipsen is calling for a new program of "Reform First" before dangerous felons are released from prison. He cites the labeling of first-time and small-time drug offenses as "Felony" has added to the jail-prison overcrowding by felonizing many in our society who should have an opportunity to prove they are not "hard core" drug offenders by working at a full-time job for one year, after which their sentence would be reduced from "felon" to misdemeanor.

Prison Overcrowding:  The state of California is arguing that a federal court order mandating the state to reduce the prison population by 40,000 over two years is too drastic a measure that will endanger public safety. The case stems from two lawsuits that have been winding their ways through the courts for years challenging the health care available in the overcrowded prison system.

State corrections facilities already are overcrowded. Various programs including drug courts and day report centers have been devised to keep some non-violent offenders out of the system, but they have not been enough.
